Terms and Conditions

These Terms and Conditions are effective as of 27/09/2024.

At Sapphire Spirituality and Meditation Retreat (‘we’, ‘our’, or ‘us’), we are committed to providing practices to transform you into a more fulfilled version of yourself. That is why we encourage you to carefully read the Terms and Conditions.

  1. Acceptance of Terms
    1. By registering for and participating in classes offered by us, you agree to these Terms and Conditions.

 

  1. Class Registration
  1. Registration for classes can only be completed online through the booking form.
  2. Payment must be received prior to the start of the class to secure your spot.
  3. All prices are inclusive of Goods and Services Tax (GST), where applicable.

 

  1. Your Obligations
    1. You agree to attend class at the agreed start time.
    2. You agree that you must not attend a class if you are unwell or suffering from an infectious or communicable disease such as COVID and influenza.
    3. We may be required to act if there is an emergency including calling an ambulance. You agree to be liable for, and to indemnify us and hold us harmless in respect of, any costs that we may incur arising from or in connection with any such emergency.
    4. You must not use our website, including the content, in any way that competes with our business. If you breach this term, we will hold you responsible for liability we suffer and hold you accountable for any profits that you may make from non-permitted use.
    5. This clause will survive termination of these Terms.
  1. Cancellation and Refund Policy

  1. Class Cancellation by Participant:
    1. If you need to cancel your participation in a class, please notify us in writing by email to sapphiresmr@outlook.com or text message to 0405800222 as soon as practicable.
    2. Cancellations made more than 72 hours before the class will receive a full refund to the original payment method.
  • Cancellations made less than 72 hours before the class will not be eligible for a refund or class credit.
  1. You acknowledge that the cancellation fees are a genuine pre-estimate of our loss, as we reserve a place in a class for you, and your late cancellation may mean we cannot re-book another class participant for that timeslot.
  2. Your participation in a class will not be cancelled until we provide confirmation of the cancellation in writing.

  1. Class Cancelation by Us:
    1. In the unlikely event that we need to cancel a class, you will be notified via email or phone as soon as possible.
    2. If we cancel a class, you will have the option to either receive a full refund of apply the payment through class credit towards a future class.

  1. Class Credit for Future Classes:
    1. Instead of a refund, you may choose to receive a class credit for future classes. This class credit will be valid for 30 days from the date of cancellation.
    2. To request a class credit, please notify us at least 72 hours before the class you wish to cancel.

  1. No-Show Policy:
    1. If you do not attend a class and do not notify us in advance, you will forfeit the class fee and will not be eligible for a refund or class credit.

  1. Special Circumstances:
    1. We understand that unforeseen circumstances can arise. If you are unable to attend due to a medical emergency or any other exceptional circumstances, please contact us as soon as possible.
    2. We will review requests on a case-by-case basis and may offer a partial refund or credit at our discretion.

  1. Class Conduct:
    1. Participants are expected to arrive 10 minutes before the class starts and behave respectfully during classes.
    2. Disruptive behaviour may result in a removal from the class without a refund or class credit being issued.
    3. We reserve the right to refuse service to anyone who does not comply with our conduct guidelines.

  1. Consumer Guarantees:
    1. Under the Australian Consumer Law, you have consumer rights to services that are provided with due care and skill, are fit for purpose, and are as described.
    2. If a service fails to meet a consumer guarantee, you may be entitled to a remedy such as a refund or class credit.

  1. Warranties and Representations
    1. All of our warranties and representations relating to bookings for classes are set out in these Terms and Conditions.
    2. To the maximum extent permitted by applicable law and subject to section 7, all other warranties and representations are expressly excluded.

  1. Variation to Terms and Conditions:
    1. We reserve the right to modify these Terms and Conditions from time to time.
    2. Any changes will be posted on our website.
    3. Your continued participation constitutes an acceptance of the modified terms.

  1. Disputes
    1. You may not commence court proceedings relating to any dispute arising from, or in connection with, these Terms without first meeting with us to seek (in good faith) to resolve that dispute.
    2. This clause will survive termination of these Terms.

 

  1. Entire Agreement:
    1. These Terms and Conditions, together with the Waiver of Liability form on our website shall constitute the entire agreement between you and Sapphire Spirituality and Meditation Retreat in relation to bookings made through our website and shall supersede all previous agreements between you and us in relation such bookings.

  1. Governing Law:
    1. These Terms and Conditions shall be governed by and construed in accordance with Australian law.
    2. Any disputes relating to these Terms and Conditions shall be the subject of the exclusive jurisdiction of the courts of Australia.

Waiver of Liability

1. Acknowledgement of Risks

I acknowledge and understand that participation in meditation, spirituality, breathwork, basic stretch exercises, and entertainment activities (‘Practices’) run by Sapphire Spirituality and Meditation may involve physical, emotional and psychological activities that can be strenuous or stressful. I further acknowledge that such Practices carry inherent risks, including but not limited to physical injury, emotional distress, and psychological effects.

I affirm that I alone am responsible to decide whether to practice meditation and spirituality. If my health condition should change, I agree to fill out a new Form and advise my teacher.

2. Medical Conditions

If I experience any pain or discomfort, I will cease or adjust the posture or technique and ask for support from the teacher. The Practices are not substitutes for medical attention, examination, diagnosis or treatment.

By filing out this Form I affirm that a licenced physician has verified my good health and physical condition to participate. If I am pregnant, become pregnant or am post-natal or are post-surgery, by filing out this form I affirm that I have my physician’s approval to participate.

3. Compliance with Instructions

I agree to follow all instructions and guidelines provided by Sapphire Spirituality and Meditation and its representatives. I understand that failure to comply with these instructions may increase the risk of injury and that Sapphire Spirituality and Meditation reserves the right to terminate my involvement in the Practices if deemed necessary for safety reasons.

4. Release and Waiver

In participating in Practices offered by Sapphire Spirituality and Meditation I hereby release, waive, discharge and covenant not to sue Sapphire Spirituality and Meditation, its affiliates, employees, instructors, agents and volunteers from any and all claims, liabilities, demands, or causes of action, whether known or unknown, arising out of or related to any injury, loss, or damage sustained in connection with the Practices.

5. Indemnification

I agree to indemnify Sapphire Spirituality and Meditation its affiliates, employees, instructors, agents and volunteers from any and all claims, demands, or causes of action brought by any third party as a result of or in connection with my participation in the Practices.

6. Severability

If any portion of this release from liability shall be deemed by a Court of a competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.
